Are you a scam? If not, please pay my commission USD $ 19,554.00

This is Terry, an experienced internet marketer in Hong Kong. I have promoted Jaman.com through Linkshare in the past year.

Here are the commissions I earned ($1.00 per valid lead) from Aug 2008 to Apr 2009.

Aug-2008: $3.00 paid on 2008/11/7

Sep-2008: $2.00 paid on 2008/12/18

Oct-2008: $75.00 paid on 2008/12/18

Nov-2008: $1,186.00 paid on 2009/1/2

Dec-2008: $1,001.00 unpaid

Jan-2009: $125.00 unpaid

Feb-2009: $1,613.00 unpaid

Mar-2009: $16,698.00 unpaid

Apr-2009: $117.00 unpaid

At the first beginning, I just tried to promote their website, so the commissions I only earned a little on Aug, Sep & Oct 2008. On Nov & Dec 2008 I promoted more and earned more. On Jan 2009 I was on holiday. On Feb & Mar 2009, their affiliate manager asked me to promote more, so I was trying my best to promote their website. Of course I invested much time and money for promoting their website. On Apr 2009, Jaman.com left Linkshare and I haven’t promoted them any more.

They changed three affiliate managers during these days.

From Feb 19th, I communicated with G** J**, he said "you've done a great job in marketing our site" and asked me to promote more. So I promoted more.

But then he left Jaman.com then and asked me to contact J** O**.

From Mar 21st, I communicated with J** and he replied "I have forwarded your request for payment to our accounts payable person." and "Your efforts have been great. your efforts have been very helpful." So I promoted even more.

But then he left Jaman.com and asked me to contact L** L**.

From Mar 31st, I communicated with L** L** and he replied " Please send me a copy of the invoice." After that he just neglected all of my emails. And when I called him, someone answered the call and said “Sorry you dialed a wrong number.”

Jaman.com, I understand your days may also be very hard in the economic recession. Some news source reported that you have laid off most of your staffs (from 30 stuffs to only 5 stuffs).

But would you please kindly reply me and tell me when will you make the payment.

I have tried to contact you by a lot of methods in the past days without any replies, so I try to publish this public letter on my blog and some webmaster forums for seeking your reply or other ones’ suggestions.

About my marketing method

I mainly promoted Jaman.com by Google Adwords.

On Feb 19, their affiliate manager G** J** contacted me about this issue.
Then I replied and explained to them while I paused my campaign.
After a few emails, he said on March 3rd:
"Given the great job that you have done for Jaman, we are willing to make an exception. So please continue using CPC for Jaman, and we will compensate you for your work."
Then I resumed my campaign and invested even more, so all the CPC marketing efforts on Mar & Apr were allowed by them.
Here are the emails he wrote to me:

I noticed that we had an increased number of referrals from your site which is great for us. I looked at JustSearchOnline.com and noticed
that I didn’t see any Jaman affiliate banners. I just wanted to get some feedback from you in terms of how you’ve been able to make the
creative work, keyword bidding, banners, textlinks, etc., and how you’re reaching out to your users to get them to click through to
Jaman. This would be valuable information for me in improving relationships with other affiliates. We’re always looking to improve
the quality and efficiency of our affiliate program.

Then I replied and explained all of my marketing method carefully (not enclose here).

After a few days, he replied.

Hi Terry,
Thank you so much for your e-mail. I did receive your response.
I am very familiar with Google Ad Sense. We actually have someone in-house who manages our SEO and SEM efforts through Google. As a result, we do not permit our affiliates to drive traffic and users through keyword bidding as explicitly stated in our terms and conditions.
In terms of previous payment, your November payment was sent in December. Your December payment was put on hold because attempts to reach you and learn about your affiliate referral methods failed.
As affiliate use of PPC marketing on Google AdSense and elsewhere is against our terms, I must ask you to stop the practice of keyword bidding immediately. In addition, I have spoken with our CEO and unfortunately, given the nature of your referral methods, I will not be able to process your December or January payments. We would be more than happy to work with you on other ways to drive traffic to our site if possible.

Then I paused my campaign, and replied him, said that though I was using CPC, but without TM bidding, and all the traffic and leads are valuable.

Then he replied a few days later.

Thank you for your patience. I wanted to discuss this matter with our management team before making a final decision.
We took a look at your referrals specifically and decided that you've done a great job in marketing our site. As a result, I am going to make
an exception to our general terms and conditions and allow you to continue keyword bidding via Google.
I will remove the Hold on your payments and process the December, January and February amounts as soon as February statements become available in Linkshare which should be some time this week.
I apologize for any inconvenience. Of course I realize that you pay upfront for AdWords and count on affiliates to reward your search efforts. We value the efforts of our affiliates and want to reward them for all of their efforts. It's not that we disapprove of all CPC, we just generally request that affiliates ask first before they do it.
Given the great job that you have done for Jaman, we are willing to make an exception.
So please continue using CPC for Jaman, and we will compensate you for your work.

I was very very very happy when I received this email. Then I went on to promote Jaman.com via Google Adwords. I invested more and more on March & April 2009 and earned more, but now they just don’t reply my email and want to hold my commissions or even reserve it. If that, I should tell the publc: Jaman.com is a big SCAM!
